Q&A

 

  1. With the new guidelines on unemployment, would a business owner who is forced to close his/her business be eligible for unemployment?Owner/Operator eligibility:
    Yes, under CARES business owners are eligible for UC.  They are, of course, eligible for EIDL and PPP Loans to pay themselves—as part of the business’ payroll (proportionately capped at $100,000 of salary).  This includes sole proprietors, independent contractors and so-called “gig” employees, or freelancers — people who work form assignment to assignment (e.g., a writer or columnist).
  2. If a business was required to close, and thus laid off their employees, would they be eligible for the CARES loan?  Should they hire their employees back and then apply for the loan?  What is the best course of action?Hire people back! The goal of CARES is to keep businesses open and people on the payroll—or bring them back.  If employees were laid off due to COVID-19, you may bring them back and pay them under PPP.If you apply for PPP and include employees in your payroll, and then subsequently fire them/lay them off or greatly reduced their salary, it could impact your ability to have your loan converted to a grant. If—after you apply and get your PPP—you reduce payroll to fall to less than 75% of what it was, you lose your ability to convert your loan into a grant.
  3.
